Terms of service
TERMS OF SERVICE
OVERVIEW
Welcome to Anna Miller Art. The terms “we”, “us” and “our” refer to Anna Miller Art, operated by SCHEGOL ARTE S.L.
Anna Miller Art operates this website and online store, including all related information, content, features, tools, products and services in order to provide customers with access to our artwork and related products (the “Services”).
Our store is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with any policies referenced within them, describe your rights and responsibilities when using our website and purchasing from Anna Miller Art.
By accessing, browsing or using our website or placing an order, you agree to these Terms of Service and our Privacy Policy.
Nothing in these Terms limits or excludes any mandatory consumer rights that apply to you under applicable law.
SECTION 1 – ACCESS AND USE OF THE WEBSITE
You may use our website only for lawful purposes.
You are responsible for ensuring that any information you provide when placing an order, creating an account or contacting us is accurate, current and complete.
If you create an account, you are responsible for maintaining the confidentiality and security of your login details and for activity carried out through your account.
You must not misuse the website, interfere with its operation, attempt unauthorised access, introduce malicious software or use the website in any way that violates applicable law.
SECTION 2 – OUR PRODUCTS AND HANDMADE ARTWORK
Anna Miller Art specialises in handmade resin and mixed-media artwork, decorative pieces and functional art.
We make every reasonable effort to display and describe our products accurately. However, colours may appear differently depending on your screen, device settings and lighting conditions.
Because many of our products are handmade, variations in resin patterns, waves, cells, textures, colour placement, shimmer, wood grain and other artistic details are a natural part of the work.
Where an item is made from a standard design, the finished piece will follow the overall design, style, colour palette and description shown or agreed, but no two handmade pieces will ever be completely identical.
These natural handmade variations are not considered defects.
Where a customer requests specific customisation, including particular colours, dimensions, composition, design details or other requirements, these will be agreed before or during production where reasonably possible.
Product descriptions, availability and specifications may be updated from time to time.
SECTION 3 – ORDERS
When you place an order through our website, you are making an offer to purchase the selected product or products.
An order is accepted once payment has been successfully processed and we confirm the order.
We reserve the right to decline or cancel an order where reasonably necessary, including in cases of:
• incorrect pricing or product information;
• payment problems;
• suspected fraud or misuse;
• inability to fulfil the order;
• an obvious technical or website error; or
• circumstances outside our reasonable control.
If we cancel an order after payment has been received, any amount due to you will be refunded to the original payment method.
Please review your order carefully before submitting it, particularly measurements, colours, customisation options and delivery information.
Cancellations, returns and refunds are governed by our Returns & Refunds Policy together with any mandatory consumer rights that apply under law.
SECTION 4 – MADE-TO-ORDER AND CUSTOM WORK
Many Anna Miller Art pieces are handmade after an order is placed rather than held as finished stock.
Production times vary depending on the product, size, materials required, current workload and complexity of the piece.
Any production timeframe provided is an estimate unless we have expressly agreed otherwise in writing.
Customised or personalised pieces may include modifications to size, dimensions, colours, composition, design or other individually agreed details.
Because handmade resin artwork develops organically during production, exact replication of resin patterns, cells, waves or movement shown in previous pieces is not possible.
Where photographs of previous work are used as a reference, they indicate the intended style and overall appearance rather than an exact duplicate.
SECTION 5 – PRICES AND PAYMENT
Prices displayed on our website are those applicable at the time an order is placed unless there is an obvious pricing error.
Applicable taxes will be displayed or included as required by law.
Shipping charges, where applicable, are calculated according to the destination, product and shipping profile and will be shown during checkout.
For international orders, customers may also be responsible for customs duties, import taxes or other charges imposed by the destination country unless expressly stated otherwise.
We reserve the right to change prices at any time, but changes will not affect orders that have already been accepted.
Payment must be successfully authorised before an order can be processed.
SECTION 6 – SHIPPING AND DELIVERY
We take care to package artwork securely for transport.
Estimated production and delivery times are provided in good faith but are not guaranteed unless expressly agreed otherwise.
Delivery may be affected by circumstances outside our reasonable control, including carrier delays, customs processing, adverse weather, transport disruption, strikes or other unforeseen events.
Where consumer law applies, responsibility for loss or damage during transport will pass in accordance with applicable law.
If an order arrives visibly damaged, please retain all packaging and contact us as soon as possible with clear photographs of both the item and its packaging.
Shipping, delivery and customs information is also governed by our Shipping Policy.
SECTION 7 – RETURNS, CANCELLATIONS AND REFUNDS
Returns, cancellations and refunds are governed by our Returns & Refunds Policy.
Due to the handmade and made-to-order nature of many Anna Miller Art products, returns and exchanges are generally not accepted except where required by applicable law.
Customised and personalised products may be excluded from change-of-mind cancellation or return rights where permitted by law.
Nothing in these Terms or our Returns & Refunds Policy affects your mandatory statutory rights.
SECTION 8 – DAMAGED, DEFECTIVE OR INCORRECT ITEMS
If an item arrives damaged, defective or materially different from what was ordered, please contact us as soon as possible.
We may ask you to provide photographs of the artwork, packaging, shipping label and any visible damage so that we can assess the issue and, where appropriate, raise a claim with the carrier.
Depending on the circumstances and your applicable consumer rights, an appropriate remedy may include repair, replacement, partial refund or full refund.
Nothing in this section limits any legal guarantee or statutory remedy that applies to you.
SECTION 9 – INTELLECTUAL PROPERTY
All original artwork, product designs, photographs, videos, written content, branding, graphics and other creative material displayed on this website belong to Anna Miller Art, SCHEGOL ARTE S.L. or their respective licensors unless otherwise stated.
They are protected by applicable intellectual-property laws.
Purchasing an original artwork or product does not transfer copyright or other intellectual-property rights in the artwork or design.
You may not reproduce, copy, distribute, commercially exploit, manufacture from, modify, publish, sell reproductions of or otherwise use our artwork, designs, photographs, videos or website content without prior written permission.
You may share photographs of purchased artwork for normal personal and non-commercial purposes.
All rights not expressly granted are reserved.
SECTION 10 – THIRD-PARTY SERVICES AND LINKS
Our website may include links, integrations or services provided by third parties.
We are not responsible for the content, privacy practices, availability or accuracy of independent third-party websites or services.
If you choose to use or purchase from a third party, their own terms and policies will apply.
SECTION 11 – RELATIONSHIP WITH SHOPIFY
Anna Miller Art is powered by Shopify, which enables us to provide the Services to you.
However, all sales made through this store are made directly between you and Anna Miller Art / SCHEGOL ARTE S.L.
Shopify is not the seller of the artwork or products purchased through our store.
Certain aspects of your use of the website and checkout may also be subject to Shopify’s applicable terms and privacy practices.
SECTION 12 – PRIVACY
Personal information collected through our website is handled in accordance with our Privacy Policy and applicable data-protection law.
Because our store is hosted by Shopify, certain personal information may also be processed by Shopify and relevant payment, shipping and service providers where necessary to operate the website, fulfil orders and provide our services.
Please refer to our Privacy Policy for further information.
SECTION 13 – CUSTOMER REVIEWS, PHOTOGRAPHS AND FEEDBACK
If you voluntarily submit a review, testimonial, photograph, comment or other feedback to Anna Miller Art, you confirm that you have the right to provide that content.
You grant us permission to reproduce and share that content for reasonable business and promotional purposes, including on our website and social-media channels, unless you ask us not to do so.
We will not knowingly publish unlawful, defamatory, abusive or infringing content.
SECTION 14 – ERRORS AND INACCURACIES
Occasionally our website may contain typographical errors, inaccuracies or omissions relating to descriptions, prices, availability, promotions, shipping costs or other information.
We reserve the right to correct genuine errors or update information at any time.
Where an obvious error affects an order that has already been placed, we will contact you and provide an appropriate solution, which may include cancellation and refund.
SECTION 15 – PROHIBITED USES
You must not use this website:
• for unlawful or fraudulent purposes;
• to infringe our rights or the rights of others;
• to upload or transmit malware or malicious code;
• to attempt unauthorised access to our systems;
• to scrape, reproduce or commercially exploit our content without permission;
• to impersonate another person;
• to submit deliberately false or misleading information;
• to interfere with the security or proper operation of the website; or
• in any way that violates applicable law.
We reserve the right to restrict or terminate access where we reasonably believe these Terms have been violated.
SECTION 16 – WEBSITE AVAILABILITY
We aim to keep the website available and functioning properly, but we cannot guarantee uninterrupted or error-free access at all times.
We may temporarily suspend or modify parts of the website for maintenance, security, technical reasons or improvements.
Nothing in this section affects your rights relating to an order that has already been accepted.
SECTION 17 – LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful, including any liability or consumer right that cannot legally be excluded.
To the fullest extent permitted by law, Anna Miller Art and SCHEGOL ARTE S.L. will not be liable for indirect or consequential losses that were not reasonably foreseeable at the time a contract was formed.
We are not responsible for losses resulting solely from circumstances beyond our reasonable control.
These limitations do not affect your statutory consumer rights or any legal rights relating to defective, damaged or non-conforming goods.
SECTION 18 – FORCE MAJEURE
We will not be responsible for delay or failure to perform an obligation where this is caused by circumstances beyond our reasonable control.
These may include severe weather, natural disasters, fire, war, civil disturbance, strikes, transport disruption, government restrictions, customs delays, interruption of utilities, supply-chain disruption or similar events.
If such circumstances materially affect your order, we will contact you where reasonably possible and work with you towards an appropriate solution.
SECTION 19 – SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be interpreted or limited to the minimum extent necessary, and the remaining provisions will continue in effect.
SECTION 20 – WAIVER
If we do not immediately enforce a provision of these Terms, that does not mean that we waive our right to enforce it later.
SECTION 21 – CHANGES TO THESE TERMS
We may update these Terms of Service from time to time to reflect changes to our website, services, business practices or legal requirements.
The current version will be published on this page.
Any changes will apply from the date the revised Terms are published, subject to applicable law.
Changes will not retrospectively alter rights relating to an order already accepted unless required by law.
SECTION 22 – GOVERNING LAW
These Terms and contracts formed through this website are governed by Spanish law.
If you are a consumer, nothing in this clause deprives you of any mandatory protections you are entitled to under the laws applicable to you.
Any dispute will be handled by the competent courts in accordance with applicable consumer and jurisdictional law.
